IMPLEMENTATION AND JURISDICTION

The Government of India, Department of Consumer Affairs under the Ministry of Consumer Affairs, Food & Public distribution are responsible for defining and implementing Legal Metrology Standards in India.

The Legal Metrology Act, 2009 was introduced under central jurisdiction as a model act, each state in India has a will to adopt the act with or without modifications. Some states in India have modified the act to regulate the issues and matters related to legal metrology Registration.

The Legal Metrology Act, 2009 was introduced in order to safeguard consumer interest and rights. Legal Metrology Registration treats weight and measurement unit, in relation to the mandatory legal requirement which have the object of ensuring public guarantee from the reference of security and accuracy of the weight and measurement.

“Pre-Packaged Commodity” means a commodity is placed in a package of whatever nature without the purchaser being present, whether sealed or not, so that the product contained therein has a pre-determined quantity;

“Label” under Legal Metrology Act means any marked, written, stamped, graphic or printed matter affixed to, or labelled upon any pre-packaged commodity.

Retail sale price means a “retail dealer” in relation to any Packaged commodity who directly sells such packages product to the consumer and includes a wholesale dealer who makes such direct sale to the consumer.

Yes, the Legal Metrology Registration Rules are applicable to both imported Packages and Indigenous Packages.

All pre-packaged commodities except exempted product from the Legal Metrology rules are covered under the rules. The exemption is given for Fast food, Drugs items and those packaged commodities that are sold in the packages upto 10g or 10ml.

The below-mentioned declarations are required to be given on all pre-packaged commodities meant for retail sale:

  1. Name and address of the manufacturer/packer/importer.
  2. Common or generic name of the product in the package form.
  3. Net quantity, in terms of standard unit of weight or measure or in number.
  4. Month and year of manufacture/Packer/import.
  5. Retail sale price in the form of Maximum Retail Price (MRP) Rs…Inclusive of all taxes.
  6. Consumer care details.
